ClearPath Provider Documentation Platform

This Privacy Policy explains how ClearPath Professional Services LLC ("ClearPath," "we," "our," or "us") collects, uses, stores, and protects information about users ("you" or "Provider") of the ClearPath platform and related services (the "Service"). By using the Service, you agree to the practices described in this Policy.

When using our iOS or iPadOS application, we may additionally collect device identifiers, iOS version, app version, and device model for diagnostic and compatibility purposes.

1.3 Mileage and Transportation Data (Optional Add-On)

If you subscribe to the ClearPath Mileage add-on, we collect trip dates, starting and ending locations, distance traveled, and associated client identifiers. This data constitutes Protected Health Information (PHI) when linked to a client record and is handled under the terms of your executed Business Associate Agreement. Location data is entered manually by you and is not collected automatically by your device's GPS.

IMPORTANT: Do not enter real client names, Medicaid IDs, or any other Protected Health Information into trip records until a Business Associate Agreement (BAA) between you and ClearPath is fully executed. Prior to BAA execution, use only test or synthetic data.

1.4 User-Generated Content

You may upload or create within the Service:

IMPORTANT: The entry of Protected Health Information (PHI) is prohibited until a Business Associate Agreement (BAA) is executed. See our Terms of Service, Section 5. Prior to BAA execution, do not enter real client names, Medicaid IDs, dates of birth, or any other PHI.

In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity, subject to the same privacy protections described in this Policy. You will be notified of any such transfer.

We may share information with third parties when you have given us explicit consent to do so.

However, no method of electronic transmission or storage is 100% secure. ClearPath cannot guarantee absolute security of your information. In the event of a data breach affecting your information, ClearPath will notify you as required by applicable law.

5. Data Retention

ClearPath retains your account information and User Content for as long as your account is active and for 30 days following account closure, during which you may export your data. After 30 days, active data is permanently deleted. Automated backup copies may persist for up to 90 additional days before deletion.

ClearPath may retain certain records longer if required by applicable law or legitimate business necessity (e.g., billing records, legal dispute documentation).

7. Cookies and Tracking

ClearPath uses essential cookies and similar technologies necessary for authentication, session management, and core platform functionality. We do not use advertising cookies or share data with advertising networks. You may configure your browser to refuse cookies; however, doing so may impair certain Service functionality including login persistence.

8. iOS Application — Apple App Store

The ClearPath iOS and iPadOS application is available as a free download from the Apple App Store. The iOS app does not process payments or offer in-app purchases. Subscriptions are purchased exclusively on the ClearPath website. When you use the iOS app, Apple may collect certain usage and diagnostic data in accordance with Apple's own Privacy Policy. ClearPath does not control Apple's data collection practices.

9. Third-Party Links

The Service may contain links to third-party websites or resources. ClearPath is not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before providing any information.

10. Children's Privacy

The Service is intended for use by adults and licensed professionals only. ClearPath does not knowingly collect personal information from individuals under the age of 18. If we become aware that a minor has provided personal information, we will take steps to delete it promptly.

11. Changes to This Policy

ClearPath may update this Privacy Policy from time to time. For material changes, we will provide at least 30 days' advance notice via email to your registered address. Continued use of the Service following notice constitutes acceptance of the updated Policy.
